A state appeals court is denying a 34-year-old man’s request to put his case on hold in a downtown Appleton shooting.
Henry Nellum is challenging the felony murder charge against him for the death of 33-year-old Jimmy Sanders of Milwaukee.
Prosecutors say Nellum fired a shot at a man at Jack’s Apple Pub in May of last year. Appleton Police Lt. Jay Steinke shot Sanders, while firing at Nellum. Sanders was a bystander.
Prosecutors say they can charge Nellum with felony murder because he started the incident that led to the death of Sanders.
Nellum asked judges on the appeals court to delay his trial, until they rule on his case.
