To tweet or not to tweet?

To tweet or not to tweet, that is the question today on the PhilCast.

There is an interesting debate taking place across the country regarding the question of people being allowed to use Twitter in the courtroom.

On the one hand some judges say it can be distracting to the jurors and could lead to information going out to them that they shouldn't see. But on the other hand reporters ask how tweeting is any more distracting than taking notes.

Right now there is no rule that covers this and judges are making decisions as they go from case to case. Some even allow photos to be taken as long as no member of the jury is in any picture.

Should people/reporters have the right to tweet in the courtroom or should we just be telling everyone to turn everything off while they are in a court of law? Heck, some jurors have even been tweeting during the trial they are sitting in on.
