DOJ responds to Avery motion
0 0

About a month after Steven Avery's lawyer filed a more than 1,200 page motion, asking for a new trial, the state justice department is responding.

A jury found him guilty of the 2005 murder of Teresa Halbach.

Assistant Attorney General Tom Fallon wrote a letter to a Sheboygan County judge, arguing that the court can only take up three of Zellner's arguments. He says they're the test results from Halbach's key, the hood latch from her RAV-4, and a bullet from Avery's garage that had Halbach's DNA on it.

Fallon says any other arguments need to be made to a state appeals court.

Zellner is asking the Sheboygan County judge to take up all of her claims.
