Feb. 11, 2010 When 39-year-old Scott Schmidt stands trial next month on charges of first-degree intentional homi cide and attempted murder, he won't be able to argue that he was provoked before the shooting.
The former Appleton firefighter was in Outagamie County court yesterday for a motion hearing. District Attorney Carrie Schneider says Judge John Des Jardins met with Schmidt in his chambers to discuss the defense strategy, before ruling that it didn't have merit.
Court records say Schmidt admitted to killing his estranged wife, Kelly Wing Schmidt, and wounding her mother during an argument last April.
He already pleaded not guilty by mental disease or defect.
Schmidt's trial is scheduled to start on March 4 and it will be heard by jurors from Portage County. |
