News » Appeals court reinstates minimum markup law
Sept. 3, 2010 A federal appeals court is reinstating the state's minimum markup law on gasoline.
The 7th Circuit Court of Appeals ruled today that the law is constitutional, overturning a lower court decision.
The Wisconsin Petroleum Marketers and Convenience Store Association appealed the earlier decision. The group argues that without it, small gas station owners would be driven out of business by larger competitors.
The federal judge who ruled against the law last year said that it could not be enforced because it conflicted with federal antitrust laws. |
