An Outagamie County judge won't decide until next month whether to exclude evidence and testimony from the trial of the suspect in a sexual assault outside of the Fox River Mall.

Jamie Sames and his attorney are arguing that the process that police used to identify the suspect unfairly targeted the Minnesota man because investigators didn't show a 13-year-old girl any video of other men.

Court records say Sames posed as a police officer and confronted a teen outside of Target.about shoplifting. He's accused of having sexual contact with her, after taking the girl behind a dumpster.

Judge John DesJardins could make a ruling next month, after he receives written arguments from attorneys on both sides. He presided over a motion hearing that ended this morning.
