There’s a deal in a more than 10-year-old murder case in New London.
Instead of holding a second trial prosecutors and 42-year-old Chad Magolski reached a plea agreement in the murder of 77-year-old James Park. Park was found dead in his apartment in December of 2007. Magolski lived in the same building and a jury found him guilty of first-degree intentional homicide in 2012. He was serving a life sentence without the possibility of parole until a state appeals court overturned Magolski’s conviction three years ago.
The state justice department was planning to re-try Magolski. Magolski entered an Alford plea last week to a charge of felony murder-armed robbery. That means Magolski doesn’t admit guilt but he understands there’s enough evidence for a conviction.
Outagamie County Judge Mitch Metropulos found Magolski guilty and ordered him to spend 20 years in prison. Magolski will get nearly seven years of credit for time served. He’ll also have to serve 10 years on probation after he’s released.
When the case was first tried prosecutors accused Magolski of stabbing Park almost a dozen times and stealing money to pay for rent.
