A judge is refusing to set a hearing for a man claming Iowa’s “stand your ground law” protects him from prosecution in the death of an Oshkosh man.
Thirty-eight-year-old Joshua Sadlon died after a bar fight in January in Urbandale, Iowa. Forty-nine-year-old Rodney Henricksen is charged with second-degree murder.
A judge ruled that Henricksen must wait until his trial to show his actions were justified. His attorney argues Henricksen was defending himself from an intoxicated and aggressive Sadlon.
Police say Sadlon was punched several time in the face and head, and picked up and thrown to the floor.
Under Iowa’s law, if people reasonably think their life is being threatened, they don’t have to retreat before using deadly force.
