Brown County District Attorney David Lasee will not recommend criminal charges against a Green Bay police officer involved in a fatal shooting at the county jail.
Lasee says the victim, Jonathan Tubby, made it appear that he was armed with a gun. He says Tubby put his hands in front of him in the backseat of a squad car parked in the jail’s sally port back in October of last year and then ran at Officer Eric O’Brien. Lasee says O’Brien heard a shot that he thought came from Tubby. He says O’Brien then turned and shot Tubby eight times.
What Officer O’Brien likely heard was a less-than-lethal round fired by another officer. He’s been on administrative leave since the incident.
Autopsy results showed a number of drugs in Tubby’s system.
The state Division of Criminal Investigation conducted a probe into the shooting. Green Bay police will conduct their own press conference at 3:00 this afternoon.
