The state Democratic Party is filing a federal lawsuit challenging the Republican lame-duck laws that limit the powers of Governor Evers and Attorney General Josh Kaul.
The party argues the law violates the U.S. Constitution’s guarantees of a republican form of government, free speech, and equal protection.
A group of liberal-leaning organizations and a coalition of labor unions filed separate lawsuits in state court.
Evers is weighing in on one of the state lawsuits. Several unions are asking a judge to block the law, and Evers is supporting that stance.
In court papers, Evers argues the law violates separation of powers principles, and hampers his ability to direct lawsuits.
Democratic Attorney General Josh Kaul says he won’t defend the law because of a conflict. The changes also limited Kaul’s powers, and his office also believes they’re unconstitutional.
