The state justice department is arguing Steven Avery does not deserve a new trial.
Attorney General Josh Kaul is questioning the bone fragments found in a nearby quarry. He says Avery’s attorneys haven’t shown that if the bones were proven to be human, there would be a different outcome to the trial.
Avery’s lawyer Kathleen Zellner wants to use a new test on the quarry bones. Kaul says it’s not approved for forensic use.
Avery is appealing his conviction for the 2005 murder of Teresa Halbach.
