UW-Oshkosh is defending its process for investigating claims of sexual assault on campus.
A student identified only as “John Doe” is suing the school in federal court. He claims using a hearing examiner to review evidence against him violates his 14th Amendment rights to due process.
The man is accused of sexually assaulting a female student in March.
In a court filing, UWO is pointing out that other colleges use similar procedures, and they’ve been upheld as constitutional. The school argues the man doesn’t have legal grounds to file a complaint, until the process is done.
