On the same day the mask requirement will take effect, the makeup of the state Supreme Court will change.
Justice-elect Jill Karofsky will be sworn in, after defeating conservative Justice Daniel Kelly in April. That narrows the conservative majority to 4-to-3.
Governor Evers says the timing of the order “doesn’t have everything to do with it. The virus is the issue, it’s not Jill Karofsky.”
He believes the way the order was crafted, it would meet some of the Supreme Court’s concerns in the past.
In a 4-to-3 decision in May, the court threw out the governor’s “safer at home” order.
Kelly sided with the majority. Conservative Justice Brian Hagedorn joined the liberal members, in arguing the order should stand.
