A Winnebago County judge will not grant an injunction blocking further construction on a new trail along Lakeshore Avenue in Neenah.
Judge LaKeisha Haase rules that a neighborhood group failed to meet the burden of proof that they were suffering irreparable harm by the completion of the street reconstruction and the trail while the original lawsuit awaits a ruling by the Court of Appeals.
A now retired circuit court judge had ruled in favor of the city, clearing the way for construction to start last year.
