GREEN BAY, Wis–The family of a man shot to death during a standoff with Appleton Police is suing the city and an officer involved in the incident. Daniel Pesavento was shot and killed in the driveway of his home along North Birchwood Avenue while threatening officers with a handgun back in August of 2022.
His family alleges that Officer Bryce Rudebeck used excessive force in the incident, as Pesavento was not directly threatening anyone at the time of the shooting, and that other officers were preparing less-than-lethal rounds for use.

The Outagamie County District Attorney’s Office found that the officers were justified in shooting Pesavento. The family is seeking unspecified compensatory and punitive damages.
