APPLETON, Wis–A teenager convicted in a fatal shooting at the Fox River Mall will not seek to have his conviction overturned. The attorney for Dezman Ellis withdraws a motion seeking to rescind the “no contest” pleas that were entered to charges of Second Degree Intentional Homicide and Reckless Endangerment.
Ellis shot and killed Jovanni Frausto during a confrontation in the mall’s food court in 2021. He tried to argue that he accepted the plea deal because he thought he would only get a 15-year sentence.
Ellis was instead sentenced to 40-years in prison.
