Jurors will start deliberating this morning in the case of a Neenah man accused of drunk boating, after a deadly crash.
Lauren and Cassandra Laabs were killed on Lake Winnebago two years ago.
Brian Sullivan faces two counts of homicide by drunk boating. His blood wasn’t drawn until 3-1/2 hours after the crash, and both sides are arguing over whether he was legally drunk at the time.
Winnebago County Prosecutor Adam Levin told jurors he understands it’s a complicated case. He’s asking them to do the “heavy lifting” to understand the toxicology. He believes if they do that, they’ll determine Sullivan’s blood-alcohol level was above 0.08, and they’ll find him guilty.
Sullivan’s attorney, Raymond Dall’Osto says jurors can’t convict someone on estimates, it has to be on facts. He says if they can’t determine without a reasonable doubt that he was above the legal limit, then they have to find him not guilty.
The jury heard from witnesses for the past four days. Members will return at 8:15 a.m. today.
