A state appeals court is upholding the 11-year prison sentence for a Neenah man convicted of defrauding a scrap metal company.
The judges rejected arguments from Sterling Kienbaum that his state sentence exceeded federally-mandated maximums for the same crime. He also claims the money he had to return, through a civil lawsuit, should’ve been considered.
Kienbaum was found guilty of packing scrap vehicles with dirt, while he owned Fox Valley Iron and Metal. He then sold them for inflated prices to Sadoff Iron and Metal in Fond du Lac for several years.
