MADISON, Wis–The Wisconsin Supreme Court rules that the town of Buchanan’s transportation utility fee is unconstitutional.
The Wisconsin Institute for Law and Liberty filed suit against the town after it instituted the fee to pay for road repair projects. WILL argued the fee was really a tax–and was meant to circumvent the property tax cap imposed by the state.
An Outagamie County judge initially ruled against the town. The Supreme Court upheld that ruling.

Several other Fox Valley municipalities put their plans to institute transportation utility fees on hold while this case made its way through the legal system.
