A federal appeals court upheld a decision to throw out a wrongful death lawsuit filed by the family of the man shot and killed by police during a standoff in downtown Neenah.
Michael Funk’s widow sued the city of Neenah and two police officers. Funk was a hostage at Eagle Nation Cycles in December of 2015. He was shot, after he escaped.
Police had been in a shootout with hostage-taker Brian Flatoff inside. Funk had a gun in his hand when he ran out of the building.
Federal Judge William Griesbach dismissed the lawsuit in Green Bay, in November of last year.
Flatoff was convicted of felony murder for Funk’s death. Flatoff was sentenced to 100 years in prison on 14 counts.
