Fond du Lac’s top prosecutor says a man who died in police custody overdosed on cocaine.
Thirty-seven-year-old Christopher Cary was pulled over by an officer last December 23rd.
District Attorney Eric Toney says Cary later had a medical emergency in the back of a squad car. He says there was evidence of cocaine in the car Cary was driving. He says at some point, Cary ingested the cocaine, likely to try to avoid criminal charges.
Toney says the level of cocaine in Cary’s body was twice the average from recent overdose deaths.
Toney is clearing Fond du Lac police officers of any wrongdoing, and he determined no criminal charges would be filed against them.
Cary was out on bond on cocaine charges.
