The suspect in the shooting at the transit center in downtown Appleton overdosed on a bus, and then shot an Appleton firefighter and police officer.
Outagamie County District Attorney Melinda Tempelis is laying out what happened last month, leading to the death of firefighter Mitch Lundgaard.
She says firefighters used Narcan on 47-year-old Ruben Houston, while he was on a bus that was heading from Milwaukee to Wausau.
She says Houston didn’t want to go to a hospital, and he eventually pulled out a small, 380 handgun, and fired two shots. She says one hit Lundgaard in the back, and Officer Paul Christensen was wounded in the upper leg area.
During the shootout, Tempelis says Officer Paul Christensen and Sgt. Christopher Biese fired a total of 19 shots back at Houston. Houston died at the scene.
Tempelis is clearing Christensen and Biese of any criminal charges in Houston’s death. She’s ruling that they were justified in using deadly force, based on the threat of imminent death, or great bodily harm, to themselves or others, at the hands of Houston.
The Green Bay police department handled the investigation, because it was a police shooting.
