Before shots rang out at the downtown transit center in Appleton last month, Outagamie County District Attorney Melinda Tempelis says the suspect didn’t want police to frisk him.
Because it was a medical call, and not a criminal investigation, she says there wasn’t a need to search Ruben Houston.
He was wearing a Packers jersey, and it was hanging down over his waist. Tempelis says he had the small, 380 handgun in a case that was on his belt. She thinks it looked a little like a cellphone case, or a multi-tool case. Houston didn’t pull his jersey above his waist, before he got the gun out.
Tempelis says at one point, Houston emptied his pockets to show officers what he had in them.
