A state appeals court is siding with Republicans, and putting a Dane County judge’s ruling on hold over last year’s lame-duck session.
The 3rd District Court decided the laws will remain in place while the legal fight continues. Majority Republicans used the lame-duck session to weaken the powers of the governor and attorney general.
A different Dane County judge blocked some of those laws in a separate case. That decision was based on the separation of powers between the executive and legislative branches, and it’s still in place.
After the first ruling, Governor Evers rescinded about 80 appointments, and ordered Attorney General Josh Kaul to withdraw from a lawsuit over the federal health care reform law.
