(OSHKOSH, WI) — The Wisconsin Department of Justice clears an Oshkosh Police officer in connection with a fatal shooting outside a Fleet Farm store on May 10. The DOJ reviewed body cam footage from the officer and testimony from witnesses and ruled the shooting was justified.
85-year-old Robert Lapp had taken an unloaded gun from a Fleet Farm clerk and proceeded to load it with ammunition from his pocket. The first officer to arrive saw Lapp coming toward him and ordered the suspect repeatedly not to reach for the gun. Lapp pulled the weapon from his wasteband and aimed at the officer.
The officer responded by firing two rounds–one of which struck Lapp in the abdomen. Other officers arrived and provided life-saving measures on Lapp that were unsuccessful.
The DOJ found that the severity of the crime and immediate threat posed to other people in the parking lot justified the use of deadly force.
